VIPure Membership Terms And Conditions PURE Cosmetic Center

1. You represent that all information provided to PURE Cosmetic Center (“PURE”) while enrolling and throughout your participation in your membership is true and accurate, and you agree to update such information, as necessary to maintain its truth and accuracy. PURE reserves the right to approve, deny, or revoke your enrollment in any membership program at any time for any reason, at its sole discretion.
2. All memberships are for a 12-month term (“initial period”). After the initial period, membership automatically renews each month. To stop automatic renewal after the initial period or to cancel your membership, at least a thirty (30) day written notice is required. To cancel your membership, please send an email to membership@purecosmeticcenter.com. If you are still within the initial period and would like to cancel, a cancellation fee equal to the sum of three (3) months of your monthly membership fee will be assessed. This is in addition to the membership fee for the last month of membership. For cancellations after the initial term, you must provide written notice of cancellation at least thirty (30) days before the end of the current membership quarter, and the membership will be set to terminate at the end of the current membership quarter. You are responsible for all membership fees up to the end of the quarter.
3. Your membership starts the day you sign up for the membership program, and renews on the monthly date of your signup. Your member discounts and benefits renew for accrual on this date as well.
4. Complimentary membership services must be utilized within the specified period and will not accrue. Unused membership services will be forfeited if not used within the specified period. Services are subject to the member’s candidacy for treatment. No substitutions for services are allowed if members are deemed by the provider as not fit for treatment.
5. You may accrue rewards points as part of your membership. These points do not expire and can be redeemed for medical spa services only. A licensed healthcare provider must deem that a service is medically appropriate for you prior to redemption. PURE reserves the right to revoke, change, or adjust redemption values and/or services available for redemption at any time for any reason. These redemption points do not hold a cash value, are not transferable, and are forfeited upon termination.
6. Membership pricing, promotions, and offers are non-transferrable. They are exclusively for use by members only and only during the specified period.
7. Training, marketing, flash sale specials, and other promotions are not eligible for membership discounts unless otherwise specified.
8. Late arrivals may result in a shortened appointment or rescheduling (charges may apply). To cancel or reschedule your appointment, please call the office directly.

9. By joining the membership program, you authorize PURE or its payment processing company or agent, such as RepeatMD, to charge your Payment Card (e.g. Visa, Mastercard, or Discover) on a recurring monthly basis beginning on the day you sign up for the membership program and on the anniversary date of every month thereafter (the “Billing Cycle”) until you cancel or PURE suspends, ends, or otherwise terminates your membership. You hereby accept responsibility for all charges and/or recurring charges made to your Payment Card by us for the VIPure Membership prior to cancellation or termination. Unless you cancel by providing written notice, the VIPure Membership will be automatically extended for successive monthly periods at the then-current subscription rate. If you cancel your membership, you may use your Membership Benefits until the end of the same membership quarter. Your failure to terminate and/or continued use of the VIPure Membership serves as consent to allow PURE to continue charging your Payment Card as specified above.
10. PURE charges you for your membership using the Payment Card (e.g. Visa, Mastercard, or Discover) you provide at the time of enrollment. By enrolling as a member, you authorize PURE or its payment processing company or agent, such as RepeatMD, to charge your Payment Card the monthly subscription fee, any taxes or processing fees, and/or any cancellation fees as specified herein. Your membership provides you the opportunity to use the membership benefits and your non-use will not obligate PURE to provide you with any refund, in whole or part, of your monthly subscription fee. For some Payment Cards, the issuer may charge you certain fees, such as transaction fees or other fees relating to the processing of your Payment Card. You agree that you are responsible for any such charges.
11. Any membership fee that is returned for insufficient funds, incorrect card number or card information is considered in arrears and due to PURE. Membership services and discounts are invalid and unavailable until any outstanding balances in arrears as well as the current month’s membership fee are paid.
12. Membership fees cannot be offset by any store credit or gift cards or any other promotional offer.
13. Except as otherwise required by law, you acknowledge and agree that PURE may provide any notice permitted or required under these Membership Terms via mail, email, posting on our website, SMS, in-app or push notification, or any other reasonable means. By becoming a member, you acknowledge and agree that we may communicate with you regarding your membership electronically. These communications will include notices about your account (e.g., change in monthly payments or payment amounts, confirmation emails, and other transactional information) and are part of your relationship with PURE. Such communications, as well as notices, disclosures, agreements, and other communications that we provide to you electronically, are equivalent to communications in writing and shall have the same force and effect as if they were in writing and signed by us. You should maintain copies of electronic communications by printing a paper copy or saving an electronic copy.

14. If any provision of these Membership Terms is held illegal or unenforceable in a legal proceeding, such provision shall be severed and shall be inoperative, and the remainder of the Membership Terms shall remain operative and binding on you and PURE.
15. Any failure by PURE, either in the past or future, to insist upon strict adherence to any term of these Membership Terms shall not be considered a waiver of our rights or deprive us of our rights thereafter to insist upon strict adherence to that term or any other term of these Membership Terms.
16. These Membership Terms together with any other terms and conditions, policies or agreements referenced herein, constitutes the entire agreement between the parties concerning the subject matter hereof. You expressly acknowledge and agree that you are not entitled to rely upon, and have not relied upon, any representation or warranty by PURE that is not expressly stated in these Membership Terms.
17. VIPure members will be required to sign an informed consent specific to any particular treatment selected.
18. PURE will not be bound to perform or provide any treatment that its licensed healthcare providers deem unadvisable.
